Terms and Conditions
Effective date: 16 October 2026
These terms are a contract between you and Daniel Wirtz, a sole proprietorship (eenmanszaak) trading as Markway, KvK 81308388, Johannes Uitenbogaertstraat 53, 3553 VN Utrecht, the Netherlands (support@markway.io).
They cover the Markway browser extension and the website at markway.io. How we handle personal data is in the Privacy Policy. Cookies are in the Cookie Policy.
If you buy Pro, Polar sells that subscription as merchant of record. Polar's own terms apply to the payment. These terms apply to your use of Markway.
The service
Markway lets you highlight text on a web page, edit it as Markdown, and export it. You can copy it, download a Markdown file, or send it to a notes app you connect. The website provides accounts, a template library, and, where a paid plan is offered, Pro checkout.
The core highlighter works without an account. Pro, including AI prompts, needs an account and an active subscription.
Who can use it
You must be at least 16 to use Markway. You must be at least 18 to buy Pro, unless a parent or guardian buys it and agrees to these terms. Markway is not directed at children under 16.
You are responsible for the activity on your account and for keeping the password to yourself. Tell us if you think someone else is using it.
Accounts
You can register with an email address and a password, or with Google. Give a real email address. We do not currently send a verification email or a password-reset email. There is no delete button yet; email us if you want the account closed.
We may suspend an account that seriously breaks these terms, abuses the AI or support endpoints, or creates a security risk. We will tell you the reason when we can do that without helping the abuse or breaking the law.
Pro, price, and withdrawal
Pro is optional. The price, billing period, and taxes are shown on the checkout page before you pay. Polar collects the payment, issues the invoice, and handles VAT. We do not see or store your card number. We only store whether Pro is active and until when.
If you are a consumer in the EU, EEA, or UK, you can withdraw from a paid distance contract within 14 days without giving a reason. Polar's checkout explains how to do that, because Polar is the seller.
If you want Pro to start during those 14 days, checkout may ask you to agree that the service starts immediately and that you lose the withdrawal right once performance has begun. That request is made at checkout. It is not hidden in this page. If you do not give that agreement, the 14-day right still applies.
Refunds outside that right are handled by Polar under its refund rules and the mandatory law that applies to you. If you get stuck, email us and we will help you reach them.
You can cancel renewal through Polar's customer portal. Cancellation stops the next charge. Access continues until the period you already paid for ends, unless a refund applies.
Your content and other people's content
You keep the rights to notes you write. You give us a limited permission to process that content only so we can do the thing you asked for: show it in the editor, run an AI prompt, store a message you send to support, or deliver an export.
Pages you clip may belong to someone else. You are responsible for having the right to copy them. Markway does not give you any right in those pages.
Curated templates in the library are part of the service. You may use them inside Markway. You may not resell them or present them as your own product. Templates you create stay yours and stay on your device.
Acceptable use
Do not:
- Break the law, or help someone else break it
- Try to get into another person's account, or probe or overload the service
- Send malware, or abuse the AI, feedback, or help endpoints
- Use AI output as if it were professional advice without checking it
- Remove copyright or attribution notices from the extension or the website
We may throttle or block requests that threaten the service. AI prompts are limited per hour for this reason.
Note apps and webhooks
Connecting Roam Research, or another notes app included in your build, is your choice. That app's terms govern what it does with the note. Keys and webhook addresses you enter are stored in the extension, not in your Markway account. Local apps such as Obsidian, Logseq, and Anytype are contacted on your computer.
Our intellectual property
The extension, the website, the Markway name, and the curated templates belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use them while you follow these terms. You may not resell, copy, or reverse engineer the service except where the law expressly allows it.
Availability
We aim to keep Markway available, but we do not promise uninterrupted access. Features can change. The highlighter on your device keeps working if our website is down, except for features that call the website, such as sign-in, the template library, and AI prompts.
AI output can be wrong. You are responsible for checking it before you rely on it.
Liability
Nothing in these terms limits liability that Dutch or EU law does not let us limit. That includes liability for death or personal injury caused by negligence, for fraud, or for intent or gross negligence.
If you use Markway as a consumer, we are liable for foreseeable direct damage caused by our failure to provide the service with reasonable care. We are not liable for loss that is not a foreseeable result of breaking these terms.
If you use Markway for a business, and the law allows a cap, our total liability arising in a year is limited to the amount paid for your Pro subscription in that year, or €100 if you paid nothing that year.
The rights you have as a consumer under mandatory law stay in place. A clause here that would take those rights away is not applied to you.
Stopping
You can stop using Markway at any time by uninstalling the extension and, if you have an account, emailing us to close it. Cancelling Pro is described above.
If we end your access for a serious breach, your licence to use the service ends. Clauses that by their nature should continue, including liability limits that the law allows, ownership of content, and the law that applies, still apply.
Changes to these terms
We will post updated terms on this page and change the date at the top. If a change materially reduces what a current Pro subscriber receives, we will give at least 30 days' notice on the website before it applies, and by email when we have a working email channel to the address on the account. You can cancel Pro before that date if you do not accept the change.
Law and disputes
Dutch law governs these terms. If you are a consumer living in the EU, you keep the mandatory protection of the country where you live, and you may bring a claim in the courts of that country. We will only sue a consumer in the country where the consumer lives. If you are not a consumer, the courts of Utrecht, the Netherlands, have exclusive jurisdiction.
Please email us first so we can try to fix the problem. The European online dispute platform closed in 2025. We are not a member of a Dutch disputes committee (geschillencommissie).
